I, Insurance coverage
Jayavarman Cruise has arranged Public and Products Liability Insureance through renowned insurers that cover all
cruise related activities following international standards of quality in terms of scope of cover and limit of indemnity.
A summary of insurance cover in plase is available upon request.
J. Our respondibilites
Apart from the accommodation and services directly operated by Jayavarman Cruise, the cruise company does not
own or operate all of the transport or other facilities used in connection with its cruise program. Jayavarman Cruise
therefore cannot accept liability for negligence of the staff of these organizations. Jayavarman Cruis e make
arrangement with hotel partners, transportation companies, local boats, restaurants and other independent parties
to provide you with the travel arragements you purchase. These parties are independent suppliers over whom
Jayavarman Cruise have no di rect control. Jayavarman Cruise are not liable in the event of any failure by any
person or company to render any transportation. Accommodation or other travel service to be provided on the
journey, or for expenses incurred due to delays caused by the wea ther, strikes, war, civil disturbances, natural
disasters, fligt delaysm, government actions, mechabical failures or any expenses or consequences resulting there
from, any such expenses shall be borne by the client. The participant waives any claim against Jayavarman Cruise
for any damage to, or loss of, property, or injury or death, due to any act, or negligence of any airlines, surface
transportation companies, hotels ’ partners or any person rendering any of the services or accommodation included.
In case of death or injury, loss or damage to property on board a means of transportation not owned any managed
by Jayavarman Cruise. The passenger accepts to waive any right of action against Jayavarman Cruise since any
claim shall be solely pursued against the owner of the vehicle, according to the low of the country in which these
services are rendered. Jayavarman Cruisecannot be held responsible for any claim, losses damages for delay of
baggege or other properties, inconvenience, loss of enjoyment, upset and disappointment, distress or frustrati ons,
whether physical or mental resulting from any act or omi ssion of any independent party providing services. Heritage
line shall take all reasonable steps to ensure that organizations providing services maintain sta ndards which are
acceptable within the norm in each locality.
K, Force Majeure
In the case of circumstances beyond reasonable control, for instance: War, Acts of God, strikes, catastrophes,
epidemics or disruption to duel supplies. The company may cancel the cruise and there will be a full refund of all
the monies paid by the passengers. In the event of a cruise being cancelled as a resuld of the above force majeure
situations following the commencement of that cruise period then monies will not be refunded.
L, Governing low and jurisdiction
The law governing the contract is the low of Vietnam, any dispute, controversy or claim relating to the contract shall
be resolved by one or more arbitrators appointed in accordance with the rules of concilliation an d Arbitration of the
Vietnam International Arbitration of the Cha mber of commerce. The Arbitration shall take place in Ho Chi Minh City,
Vietnam and shall be held in English.
M, Special remarks
This contract supersedes any previous contract rates of Jaya varman Cruise. This contract is valid upon acceptance
of the above terms and conditions. In order for the Jayavarman Cruise to include yo ur company in it’s listing for
preferential rates, please notify your acceptance of all terms and conditions of this co ntract by signing the duplicate
of it on all pages and by mailing it duly stamped to Jayavarman Cruise. Jayavarman Cruise should receive this
contract within 30days from the date of issue. After which this offer shall be null and avoid . Regular published rates
will be automatically applied to your bookings
Booking/Reservation/Payment policy
FIT:
If booking is outside 90 days of departure, a 10% non refundable depsit is due within
60 days after booking and the fare must be paid in full at the 30 th
day before
departure.
If booking is within 90 days of departure, a 10% non refundable deposit is due within
30 days after booking and the fare must be paid in full at the 30 th
day before
departure
If booking is within 30 days of departure the full fare needs to be paid within 5 days
after booking.
GIT:
If booking is outside 150 days of departure, a 10% non – refundable deposit is due
with 60 days after booking: 10% futher deposit is due 90 days prior to departure.
If booking is within 150 days of departure, a 10% non – refundable deposit is due
within 30 das after booking, 10% further deposit is due 90 days prior to departure.
If Booking within 60 days of departure, a 20% non -refundable deposit is due within
10 days after booking.
Final balances must be paid 30 days before departure or the booking may be
cancelled and the deposit forfeited.
A, Jayavarman Cruise has the right to ask for a down payment of 10% respectively 20%
in the case that the cruise is heavily booked or another group booking has been
requested.
B, The company reserves the full rights to release some or all of the cabins not paid by
the deadline.
C, Payments will be settled in US Dollar or Vietnam Dong ( actual exchange rate will be
based on the rate published by Vietcombank of Vietnam at the date of Payment)
Cancellation Policy
For Cancellations of bookings, the following charges will apply:
FIT:
=> 90 days or more 10%
=> 29 to 89 days 20%
=> 15 to 28 Days 50%
=> 08 to 14 days 90%
=> 07 days or less 100%
GIT:
=> 90 days or more 10%
=> 56 to 89 days 20%
=> 29 to 55 days 55%
=> 16 to 28 days 85%
=> 15 days or less 100%
